Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website averta.ioand the Averta OS platform, including the dashboard, APIs, SDKs, and related documentation (collectively, the "Services") provided by Averta Inc. ("Averta," "we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
If you or your organization have entered into a separate written agreement with Averta covering the Services (such as a master services agreement or order form), that agreement governs to the extent it conflicts with these Terms.
Use of Services
You may use our Services only in compliance with these Terms and all applicable laws. You must not misuse our Services or attempt to access them using a method other than the interface and instructions we provide. You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable regulations.
- Interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorized access to the Services or their related systems.
- Reverse engineer, decompile, or disassemble any aspect of the Services.
Accounts
To access certain features of our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
Customer Content
You and your organization retain all rights to the content submitted to or processed through the Services, including prompts, model outputs, tool-call records, policies, and configuration ("Customer Content"). You grant Averta the rights necessary to process Customer Content solely to provide, secure, and support the Services as configured by you. You are responsible for ensuring that you have the rights and consents needed to submit Customer Content to the Services.
Intellectual Property
The Services and all associated content, features, and functionality — including but not limited to text, graphics, logos, software, and documentation — are owned by Averta or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.
Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:
- Upload or transmit any material that is harmful, offensive, defamatory, or otherwise objectionable.
- Use the Services to transmit unsolicited commercial communications.
- Impersonate any person or entity or misrepresent your affiliation with a person or entity.
- Use automated means to access the Services without our express permission.
- Use the Services, including adversarial testing and red teaming features, against systems you do not own or are not authorized to assess.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
The Services provide security classification, policy enforcement, and monitoring for AI systems. Detection of threats is inherently probabilistic: no security product identifies or prevents every harmful input, output, or action, and Averta does not warrant that the Services will detect, block, or remediate all threats to your systems. You remain responsible for the configuration and deployment of the Services, for the behavior of your own AI systems and agents, and for your own legal and regulatory compliance obligations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVERTA, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.
Indemnification
You agree to indemnify, defend, and hold harmless Averta and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any rights of a third party.
Termination
We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved in the state or federal courts located in Delaware.
Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.
